- A District Court judge in Georgia has granted summary judgment in part and denied it in part in a lawsuit filed by the Consumer Financial Protection Bureau against a group of individuals and companies for engaging in a “robocall phantom debt collection scheme.”
JUDGE GRANTS MSJ FOR DEFENSE OVER USING RETAILER NAME IN LETTER INSTEAD OF ACTUAL CREDITOR
- A District Court judge in Florida has granted summary judgment in favor of a defendant that was sued for violating the Fair Debt Collection Practices Act because it used a retailer’s name in a collection letter attempting to collect on an unpaid credit card debt and not the actual issuer of the credit card.
ELEVENTH CIRCUIT RULES MORTGAGE STATEMENTS NOT COLLECTION NOTICES UNDER FDCPA
- The Court of Appeals for the Eleventh Circuit has affirmed a lower court’s ruling that a mortgage statement is not the same as a communication from a debt collector and that the statements violated the Fair Debt Collection Practices Act because they attempted to collect on a debt that was beyond the five year statute of limitations in Florida.
