DEBT BUYER ORDERED TO REPAY $25 MILLION AFTER LOSING LAWSUIT
- Joseph Onwuteaka has been ordered to repay $25 million in fines and more than $500,000 in attorneys fees after being found guilty of violating a number of state laws, including the Texas Debt Collection Act. Onwuteaka was found guilty last month of violating the Deceptive Trade Practices Act by filing nearly 900 lawsuits in Harris County, Texas against individuals who neither lived in the county nor signed their underlying loan documents in that county.
ACA PROVIDES UPDATES ON SUIT AGAINST FCC
- The lawyers representing ACA International in its case against the Federal Communications Commission provided an updated on the suit at ACA’s convention in Seattle. A decision on the suit, which was filed more than two years ago, is expected anytime, according to the lawyers.
FTC STOPS SCAMMERS WHO WERE PRETENDING TO BE LAWYERS
- A pair of Florida companies, Hardco Holdings and S&H Financial Group Inc., and a pair of individuals — Daryl M. Hall and Dequan M. Sicard — have been charged with violating the Fair Debt Collection Practices Act for allegedly calling individuals, some of them who did not even have a debt in the first place, and pretended to be lawyers. The scheme netted nearly $700,00, according to a copy of the complaint, which can be accessed here.
FTC ANNOUNCES REFORMS TO CID PROCESS
- Maureen Ohlhausen, the acting chairman of the Federal Trade Commission, announced a series of reforms yesterday aimed at streamlining and improving transparency in investigations undertaken by the agency. The Bureau announced five steps it is taking with respect to its Civil Investigative Demands, the most common tool known to the ARM industry when dealing with the FTC.
LOST PAPERWORK MAY VOID $5 BILLION OF PRIVATE STUDENT LOANS
- Missing paperwork may be the nail in the coffin that voids $5 billion of private student loans. The National Collegiate Student Loan Trusts h0lds $12 billion of student loan debt, and nearly $5 billion of that debt is in default. The New York Times has a lengthy report on the issues facing the Trust and how its “shoddy” handling of paperwork may be a harbinger of more problems to come.
