COLLECTION AGENCY LOSES MOTION TO DISMISS FCRA LAWSUIT
- A collection agency lost its motion to dismiss a lawsuit after it was accused of pulling an individual’s credit report without a permissible purpose. The individual defaulted on a rental agreement and the account was assigned to a collection agency. The agency admitted to procuring a copy of the individual’s credit report, but said it had a permissible purpose to do so. A federal judge in Indiana said that the collection agency did not “demonstrate” that the debt was involved in a “credit transaction.”
FTC WANTS TO MODERNIZE COLLECTION COMMUNICATIONS
- The Federal Trade Commission will target its resources on law enforcement in the area of consumer protection, and will prioritize cases involving fraud or “quasi-fraud,” in areas including debt collection, said Tom Pahl, the agency’s acting director of the Bureau of Consumer Protection. In the area of financial technology, or FinTech, Pahl said the agency will be focusing on debt collections, specifically “how to encourage and modernize collection communications while still protecting consumers.” This potentially could overlap with the debt collection rulemaking being undertaken by the Consumer Financial Protection Bureau.
ONTARIO SYSTEMS PARTNERS WITH TRANSUNION TO ADD CHARITY CARE INTEGRATION
- Ontario Systems has announced a partnership with TransUnion Healthcare that will give customers of Ontario Systems access to TransUnion’s solution that helps determine charity care cases in healthcare. The integration is aimed at helping Ontario Systems’ customers work accounts more intelligently and effectively, the companies said.
