STATEMENTS AFTER BK DISCHARGE DO NOT VIOLATE FDCPA: APPEALS COURT

  • Sending a statement to an individual after that individual has had a debt discharged in bankruptcy does not violate the Fair Debt Collection Practices Act, according to a ruling from the Eleventh Circuit Court of Appeals. The court opted not to expand the least sophisticated consumer component of the FDCPA because the statements said “For Informational Purposes” and included that the debt had been discharged.
