SIXTH CIRCUIT RULES PROCEDURAL VIOLATIONS NOT ENOUGH TO CARRY FDCPA ACTION
- The Sixth Circuit Court of Appeals has ruled that procedural violations in filing suits against individuals are not necessarily enough to cause “concrete” harm and may not be used as the basis of alleging violations of the Fair Debt Collection Practices Act. In this case, a law firm failed to send an electronic copy of a discovery request and also indicated that the responses had to be notarized, when they didn’t. The Appeals Court ruled that the procedural violations were not “the type of harm the FDCPA was designed to prevent.”
ACA ISSUES REBUTTAL TO REPORT SLAMMING ‘AGGRESSIVE’ MEDICAL COLLECTIONS
- ACA International has come out strongly against a report that used complaints filed with the Consumer Financial Protection Bureau as the basis for claiming that individuals are frequently the target of “aggressive” medical debt collections.
