STATE AGS FILE AMICUS BRIEF IN SUPREME COURT FDCPA CASE
- Nearly 30 state attorneys general have filed an amicus brief in support of the plaintiffs’ case in Henson v. Santander Consumer USA. The case, which will be argued before the Supreme Court in April, centers around whether a company that purchased defaulted consumer debts is defined as a debt collector under the Fair Debt Collection Practices Act. The state AGs want the purchasers of the debts to be defined as debt collectors, to ensure there is some federal law that governs how they attempt to collect on the debt.
MADDEN v. MIDLAND FUNDING CERTIFIED AS CLASS ACTION
- A federal judge yesterday certified a class action lawsuit against Midland Funding, after the Supreme Court denied Midland’s appeal to hear its case. The suit, Madden v Midland Funding LLC, accuses Midland of charging interest rates above 25% when trying to collect. The suit stems from Midland attempting to charge a 27% interest rate on a $5,000 credit card debt it had purchased.
PAI’S TCPA DISSENT UNDER MICROSCOPE FOR SIGNS OF FUTURE ACTION
- A group of lawyers have gone back to what Ajit Pai, who is now the chairman of the Federal Communications Commission, wrote back in 2015 when he was just a commissioner and objected to a declaratory ruling that amended the Telephone Consumer Protection Act. The exercise is an attempt to figure out what Pai may be likely to do now that he runs the show at the FCC. No word on whether is high school book reports are also being reviewed.
