- A federal judge for the Eastern District of New York opted last week to give the Least Sophisticated Consumer a higher IQ than some of his comrades on the bench, and gave a boost to a collection agency that obviously made a mistake that was not intended to be a violation of the FDCPA. The judge, Joseph Bianco, denied a summary judgment motion in favor of a pair of plaintiffs in a class-action lawsuit against a collection agency that was accused of sending collection letters where the amount owed was actually double the amount of the debt.
ALLTRAN EXPANDING IN TEXAS, OKLAHOMA
- Alltran has announced two new hiring binges in the past week. The company announced it plans to hire 150 workers in Tulsa, Okla., and that it will hire workers for 200 “high-paying” jobs in Bryan-College Station, Texas. The company is hosting a job fair in Tulsa today to begin the process of filling those positions. A job fair in Bryan, Texas will be held tomorrow.

- More Americans are not paying their bills on time and more have debts that have been placed with collection agencies, according to the results of a survey conducted by the National Federation of Credit Counseling. The results have led at least one mainstream media outlet to posit: Has America’s debt load reached a tipping point?
AGENCY MISTAKENLY SENDS LETTERS TO INDIVIDUALS WHO DO NOT OWE ANYTHING
- A collection agency mistakenly sent collection letters to nearly 400 individuals who did not owe anything, according to a published report. The agency sent letters, alleging the individuals had unpaid debts from traffic violations in Pinellas County, Florida.
AGENCY WINS SUMMARY JUDGMENT IN ‘CURRENT ACCOUNT BALANCE’ CASE
- A federal judge in the Eastern District of New York has granted summary judgment in favor of a collection agency after it was sued by an individual for violating the Fair Debt Collection Practices Act because a collection letter she received failed “to adequately identify the creditor to whom the debt is owed and fails to notify her that the stated amount owed might increase due to interest, fees, or collection costs.”
DELINQUENCY RATES ON AUTO LOANS, MOST CONSUMER LOANS, FELL in 4Q: ABA
- For the first time in nearly six years, the delinquency rates on eight closed-end loan categories tracked by the American Bankers Association all fell in the fourth quarter of 2017, compared with the same period a year earlier, while the delinquency rate on open-end loan categories increased in two of three categories tracked by the ABA, the association released yesterday.
