JUDGE HANGS UP ON PROFESSIONAL PLAINTIFF
- A professional plaintiff and his family were epically smacked down by a federal judge last week. Roy Tuck is attempting to sue PACER, the document filing and access service maintained by the U.S. District Courts, because it allegedly called his “emergency phone number” when trying to collect a debt for unpaid fees. Tuck also tried to sue PACER for free, asking the court to proceed without prepaying costs. The judge, who recognized Tuck’s name from a dozen settlements in other TCPA cases, said the motion could be refiled if Tuck chose to explain why his settlements in the other cases could not be used to pay his filing fees in the PACER case.
CALIF. ASSEMBLY VOTES DOWN MEASURE TO PROTECT MORE MONEY FROM JUDGMENT RECOVERIES
- The California Assembly failed to pass a measure on Friday that would have protected more money from individuals’ bank accounts when attempting to recover funds from unpaid judgments. The Assembly voted 29-28 against the measure, with 22 members of the Assembly abstaining from the vote.
UTILITY TOLD TO UPDATE TRAINING MATERIALS
- A utility in upstate New York has been told to update its training materials to provide “appropriate guidance for transferring debts where the applicant or customer claims identity theft.” The utility was charged with refusing to turn on services for customers with unpaid bills from a previous owner of the property.
