- Despite a spate of unsuccessful attempts, plaintiffs attorneys do not seem to be dissuaded from filing what have become known as “reverse Avila” lawsuits against collection agencies, but the specter of an Appeals Court decision could turn the tide back in their favor, a panel of compliance experts noted during a webinar yesterday.
FCRA LAWSUIT TOTALS INCREASING, WEBRECON DATA SHOWS
- The Fair Credit Reporting Act has replaced the Telephone Consumer Protection Act as the en vogue statute to file lawsuits against debt collection agencies, according to data released yesterday by WebRecon. The number of TCPA lawsuits is down 20% through the first two months of 2018 compared with the same period a year ago while the number of FCRA lawsuits is 7% higher this year.
STATE AGS URGE CONGRESS NOT TO PREEMPT STUDENT LOAN SERVICERS, COLLECTORS FROM STATE LAWS
- A group of 31 state attorneys general, from both sides of the aisle, have written a letter to Congress urging them not to exempt student lenders, servicers, and debt collectors from state-level oversight and enforcement. Noting that debt collectors, among other groups of financial services organizations, are required to follow state law as well as federal law, “there is no justification to upset this balance now.”
PLAINTIFF’S ATTORNEY ISSUES PRESS RELEASE ANNOUNCING FDCPA CLASS-ACTION SUIT
- If this is going to become a new trick for plaintiff’s attorneys to get more publicity for their cases, then the ARM industry may want to be aware of it. A plaintiff’s attorney has taken the somewhat unusual step of issuing a press release to announce that a class-action lawsuit has been filed against a collection agency. The agency is accused of violating the FDCPA because while the initial notice noted that the debt could be disputed, the letter did not mention that any portion of the debt could be disputed.
