Judge Grants MSJ for Defendant on 8 of 9 Claims in FDCPA Case
- A District Court judge in Pennsylvania has granted a defendant’s motion for summary judgment on seven of the nine violations of the Fair Debt Collection Practices Act it allegedly committed, denying the motion on the other two counts because the defendant failed to discuss one of the claims in its motion and because the judge said she was unable to make a credibility determination at this stage of the proceeding, regardless of how “dubious” the plaintiff’s testimony may have been.

President to Take Another Stab at Erasing Student Loan Debts
- The President is expected to announce a new initiative today to reduce or eliminate student loan debt for up to 30 million Americans in another attempt to fulfill a promise from his first campaign for president. The move is expected to be challenged by Republicans, who are calling the proposal an election year stunt aimed at winning votes of younger Americans who are saddled with tens or hundreds of thousands of dollars in unpaid student loans.

Utah Appeals Court Upholds Ruling for Defendant in FDCPA Case
- A Utah Appeals Court has affirmed the lower court’s summary judgment ruling in favor of a defendant that was sued for violating the Fair Debt Collection Practices Act because it filed a collection lawsuit against the plaintiff when it was not licensed under the Utah Collection Agency Act.
