Collector Facing FDCPA Suit Over BK Filing, Not Making SOL Disclosure
- A collector is facing a Fair Debt Collection Practices Act lawsuit for allegedly not knowing that the plaintiff had filed for bankruptcy protection — even though the debt in question was not part of the filing — and for allegedly not informing the plaintiff that the statute of limitations on the debt had expired.

Judge Dismisses FDCPA Suit Over Collection Suit Filed in Wrong Jurisdiction
- A District Court judge in North Carolina has granted a defendant’s motion to dismiss a Fair Debt Collection Practices Act case, ruling that the plaintiff failed to state a claim after accusing the defendant of violating the statute by sending a collection summons and complaint to an incorrect address, obtaining a default judgment, and garnishing the plaintiff’s wages.

- The Consumer Financial Protection Bureau yesterday announced a settlement in an enforcement action that started nearly a decade ago which will see those involved in a foreclosure relief scam pay $12 million in penalties and restitution to consumers.

FCC Bans Use of AI in Robocalls
- In an unanimous ruling yesterday, the Federal Communications Commission issued a declaratory ruling, announcing that using voices generated by artificial intelligence in robocalls is now illegal under the Telephone Consumer Protection Act. While using AI to perpetrate a fraud or scam was already illegal, the declaratory ruling now makes it illegal to use AI to generate voices in those calls, too.
