Judge Grants MTD in FDCPA Case Where Plaintiff Fails to State Claim
- A District Court judge in New York has ruled that a plaintiff’s strategy of basing her Fair Debt Collection Practices Act case on a strategy of “nuh-uh” is not enough to defeat a defendant’s motion to dismiss.

Two NC Hospitals Refuse to Work with RIP Medical Debt
- A pair of healthcare providers in North Carolina are among what I believe to be the first to refuse to work with the nonprofit RIP Medical Debt to allow the unpaid debts of their patients to be purchased by the organization and then forgiven.

CFPB Closes Consumer-Submitted Petitions for Rulemaking on Credit Reporting, Collection Limits
- In early 2022, the Consumer Financial Protection Bureau announced that anyone would be able to submit a petition for rulemaking. Since then, there have been a number of petitions filed by consumer advocacy organizations, trade groups, and ordinary people. In most cases, these petitions remain “open” and can be commented on by anyone who chooses to do so. The CFPB recently published two petitions that it had closed, and both have something to do with the accounts receivable management industry.
