Judge Denies Summary Judgment Motions from Both Sides in FCRA, FDCPA Case Over ID Theft Debt
- A District Court judge in Wisconsin has decided to let a jury decide whether a defendant satisfied its obligation to investigate an identity theft claim by sending a letter to the plaintiff asking for proof of residence — which the plaintiff claims never to have received — or whether it needed to do more when the plaintiff disputed the debt before filing a lawsuit alleging violations of the Fair Credit Reporting Act and the Fair Debt Collection Practices Act.

CFPB Orders Remittance App Provider to Pay $3M for ‘Cheating’ Consumers
- The Consumer Financial Protection Bureau yesterday entered into a consent order with a fintech company that operates a remittance transfer app that will see the company pay $3 million in fines and refunds to customers after it was accused of forcing customers to waive their legal rights, failing to provide required disclosures, and failing to properly investigate disputes and errors.
