PLAINTIFF SUES COLLECTOR FOR PURSUING COLLECTION LAWSUIT AFTER BEING NOTIFIED OF ID THEFT
- Love is blind, they say. And sometimes, love leads to Fair Debt Collection Practices Act lawsuits. A plaintiff has filed an FDCPA suit against a collector, accusing it of attempting to collect on a debt that was a result of the plaintiff’s identity being stolen by her ex-fiancee, who used the plaintiff’s information to purchase an engagement ring for the plaintiff. The engagement was called off two years later, but the defendant filed a collection lawsuit against the plaintiff seeking to recover more than $7,700.

JUDGE GRANTS MSJ IN FDCPA CASE OVER CEASE COMMUNICATION RESPONSE
- In a case that was defended by the team at Malone Lyons Watts Morgan, a District Court judge in California has granted a defendant’s motion for summary judgment in a Fair Debt Collection Practices Act case, ruling the plaintiff lacked standing to sue because he testified during his deposition that he never read the letter that was the basis for the suit in the first place.
