JUDGE DISMISSES FDCPA CASE OVER SETTLEMENT OFFER FOR LACK OF STANDING

  • An agency was sued for saying “We are willing to settle your account” because “We” implied the defendant had authority to decide the terms of a settlement, when it was the creditor’s place to do so.
  • The plaintiff also said the defendant was misleading when it said it wasn’t obligated to renew the offer, when in fact, it was.
  • Regardless of the violation, the plaintiff wasn’t injured, the judge ruled.
