JUDGE GRANTS SUMMARY JUDGMENT FOR DEFENDANT IN FDCPA CASE OVER MULTIPLE ADDRESSES ON PAYMENT COUPON
- In a case that was defended by Rick Perr and Monica Littman of Kaufman Dolowich & Voluck, a District Court judge in New York has granted a defendant’s motion for summary judgment in a class-action Fair Debt Collection Practices Act case, ruling the plaintiff lacked standing to sue because he did not suffer a concrete injury when he received a collection letter that contained multiple addresses for the defendant on the payment coupon portion of a collection letter.
REPORT CALLS OUT FEDERAL STUDENT LOAN SERVICER FOR ‘SLOPPY’ WORK
- A report released by the Student Borrower Protection Center and the Communication Workers of America is accusing one of the largest student loan servicers of a number of misdeeds, including unfair debt collection, unlawful wage garnishments, and “sloppy” student loan servicing.
CLASS ACTION ACCUSES COLLECTOR OF VIOLATING FDCPA OVER PREMATURE SOL DISCLOSURE
- A class action has been filed against a company for allegedly violating the Fair Debt Collection Practices Act by including a statement in a letter to the plaintiff that the statute of limitations had expired on the underlying debt when, according to the plaintiff, that expiration had not yet occurred.
NCLC CALLS FOR BAN ON PLACING MEDICAL DEBTS WITH THIRD-PARTY AGENCIES
- A report that has been published by the National Consumer Law Center highlights a racial gap in the amount of medical debts being carried by African-American individuals, compared to white, non-Hispanic households. The amount of medical debt owed by African-Americans is exacerbating the racial health and wealth gaps felt by individuals of different races living in the United States. To correct this, the NCLC is recommending, among other actions, the prohibition of placing medical debts with third-party collection agencies.
