JUDGE GRANTS MTD IN HUNSTEIN CLASS ACTION FOR LACK OF STANDING
- In a case that illustrates the importance of judicial selection, a District Court judge in Pennsylvania has granted a defendant’s motion to dismiss a Hunstein copycat case, ruling the plaintiff lacks standing to sue. The dismissal is in the same district in which a different judge last week denied a defendant’s motion for judgment on the pleadings — pretty much the same as filing a motion to dismiss — in a case that made almost exactly the same arguments.
ED. DEPT. WILL NOT USE TAX REFUNDS, SOCIAL SECURITY TO COLLECT ON DEFAULTED STUDENT LOANS UNTIL NOVEMBER
- The Department of Education has announced it will suspend the seizure of tax refunds, Social Security payments, and other government payments to collect on defaulted student loans through November. The announcement comes a week after the Education Department said it would not seize child tax credit payments sent to individuals to cover unpaid student loan debts as well.

CFPB CONTINUES PUSH AGAINST ‘UNAVOIDABLE’ FEES, ISSUES COMPLIANCE BULLETIN
- As part of its crackdown on what it calls “junk” fees, the Consumer Financial Protection Bureau yesterday issued a compliance bulletin to companies that distribute government payments to consumers via debit cards, making sure they are not running afoul of the Electronic Funds Transfer Act (EFTA) by not forcing consumers to receive benefits at a specific institution and ensuring consumers have choices.
