JUDGE GRANTS MSJ FOR DEFENDANT IN FDCPA CASE OVER MISTAKEN IDENTITY
- If cases of mistaken identity weren’t a real thing, there wouldn’t be so many movies written about it. If done correctly, the movie that would be written about the situation would be very boring. And that’s exactly why a District Court judge in Texas has granted a defendant’s motion for summary judgment in a Fair Debt Collection Practices Act case.
CFPB FILES MOTION TO HAVE PHANTOM DEBT COLLECTORS HELD IN CONTEMPT
- The Consumer Financial Protection Bureau has filed an emergency motion seeking to hold a pair of defendants in contempt of court for not honoring the terms of an enforcement action, and may have to resort to invoking a federal debt collection statute through which to attempt to collect on the fines and penalties that were assessed because the defendants transferred assets that were subject to a preliminary injunction.
