JUDGE DISMISSES FDCPA CASE FOR LACK OF STANDING
- Courts within the Seventh Circuit continue to attack the issue of standing in Fair Debt Collection Practices Act cases, this time dismissing a case because a plaintiff was confused about the amount that was owed after receiving a collection letter, because the plaintiff never made any attempt to pay the debt, and that decision to not pay the debt did not lead to any consequences, such as the debt being credit reported or the amount of the debt increasing. The upshot of this ruling, like many that have come before it, is plaintiffs better have done more than worry about a debt if they expect to bring FDCPA suits.
FTC SENDS $800K TO CONSUMERS VICTIMIZED IN BOGUS COLLECTION SCAM
- The Federal Trade Commission announced yesterday that it is returning nearly $800,000 to consumers who were victimized by Hylan Asset Management and its owners, which collected $24 million during the four years it was allegedly buying and selling fake debt portfolios.
ANOTHER BENEFIT FOR COLLECTORS TO PROMOTE WHEN WORKING MEDICAL DEBTS
- After publishing research showing the amount of unpaid medical debt is significantly higher than previously thought, an economics professor at Stanford has continued to analyze his data and has reached another conclusion — the financial burden of medical debt is keeping individuals from going back to see their doctors, which is leading to more health problems for those individuals. Removing those debts, the professor concludes, improves the likelihood that those individuals will go back to their doctors and get the much-needed treatment they should be getting. This research gives collectors another benefit they can promote when working medical debt accounts — paying off the debt means the patient is likely to keep seeking medical care.
ATTORNEYS GENERAL FILE COMPLAINT AGAINST SLOWER MAIL DELIVERY
