DEFUNCT AGENCY FINED $500K BY CONNECTICUT REGULATOR
- The Connecticut Department of Banking is not happy with a debt collector that filed for bankruptcy protection without making the proper notifications, among other alleged violations, and has issued a $500,000 fine, revoked its license, and ordered it to cease and desist from violating state law, although many of the penalties are likely to be moot because the collector has gone out of business.

- Ignoring a precedent that had been set by another Appeals Court and overturning a ruling that was issued by a District Court judge, the Fifth Circuit Court of Appeals yesterday ruled that the receipt of a single text message is enough to confer standing for a plaintiff to sue under the Telephone Consumer Protection Act, likening unwanted messages to a “public nuisance.”

- A District Court judge in Florida has granted one defendant’s motion to dismiss and another defendant’s motion for judgment on the pleadings in a Fair Debt Collection Practices Act case because the plaintiff lacked standing, ruling that the plaintiff should have known the collection letter in question was not misleading because he waited a year after receiving it to file his lawsuit.
