NYC TO DELAY ENFORCEMENT OF NEW LANGUAGE ACCESS RULE
- While the New York City Department of Consumer Affairs has not officially announced it, the agency reportedly has agreed to delay enforcement of its new language access rule for 60 days after it goes into effect on June 27.
CFPB TO OFFER MORE GUIDANCE, BUT COLLECTION INDUSTRY LIKELY ON OUTSIDE UNTIL FINAL RULE IS RELEASED
- Companies that are not sure about how to comply with regulatory requirements have a new authoritative source they can go to in order to get advice: the Consumer Financial Protection Bureau. The CFPB announced yesterday the creation of a new Advisory Opinion program in which it will publicly issue guidance on specific topics raised by companies in the financial services industry. But based on the criteria for issuing an opinion, it might be unlikely that the credit and collection industry will see any until the CFPB releases its final debt collection rule.
JUDGE GRANTS MTD IN FCRA CASE OVER HOW DATA IN CREDIT REPORT IS DISPLAYED
- A District Court judge in Michigan has granted a defendant’s motion to dismiss after it was sued for violating the Fair Credit Reporting Act because it allegedly failed to adequately investigate and report on a dispute that had been filed by the plaintiff, but ultimately how the data is reported is the responsibility of the credit reporting agency, not the furnisher.
