NYC ENACTS RULE REGARDING LANGUAGE ACCESS
- A new rule is set to go into effect in New York City later this month that will require debt collectors to notify individuals who do not speak or read English well about other options that may be available to help those people understand their rights and communicate with collection agencies.
JUDGE AWARDS $65k IN FEES, COSTS TO DEFENSE IN FDCPA CASE
- A District Court judge in Oregon has awarded the defendants in a Fair Debt Collection Practices Act case more than $65,000 in fees and costs — about 40% of what was being sought — ruling that the plaintiff’s claims in her lawsuit were “clearly untenable” from the outset of the case.
LAWSUIT CLAIMS PROCESS SERVER ‘HARASSED’ INDIVIDUALS, FAILED TO FOLLOW SOCIAL DISTANCING PROTOCOLS
- Philip Burgess, Jr., the founder of MicroBilt, yesterday filed a lawsuit against a trio of class action firms alleging his family was harassed by process servers, including those that made his wife and kids fear their home was being invaded and who did not wear a mask or gloves or maintain social distancing when attempting to serve documents to Burgess.
JUDGE DENIES CLASS CERTIFICATION, GRANTS MSJ IN FDCPA CASE OVER ROUNDING ISSUE
- A District Court judge in New Mexico has granted a defendant’s motion for summary judgment and denied a plaintiff’s motion to certify a class in a Fair Debt Collection Practices Act case because a number of payment options were rounded to the nearest dollar and were different than the total amount owed.
