CALIFORNIA ENACTS LAW IMPOSING SOL NOTIFICATION REQUIREMENTS ON COLLECTORS
- California Governor Jerry Brown has signed into law a bill that will require debt collectors to provide notification to individuals when attempting to collect a debt where the statute of limitations has expired. The law will go into effect on Jan. 1, 2019.
APPEALS COURT HEARS ARGUMENTS IN FDCPA CASE
- The Court of Appeals for the Third Circuit heard oral arguments yesterday in a case alleging a violation of the Fair Debt Collection Practices Act and whether a debt buyer can be held liable for the actions of a debt collector with which a debt is placed for collection.
APPEALS COURT OVERTURNS RULING DEMANDING ENTITY COMPLY WITH BCFP CID
- The Court of Appeals for the Fifth Circuit has reversed a lower court’s ruling that had required an entity to comply with a Civil Investigative Demand letter it had received from the Bureau of Consumer Financial Protection. The BCFP was not specific enough in detailing the alleged violations performed by the accused, the Source for Public Data, when it sent the company the CID, the appeals court ruled.
BCFP ISSUES STREAMLINED SUPERVISORY HIGHLIGHTS REPORT
- The Bureau of Consumer Financial Protection yesterday released its 17th Supervisory Highlights report, albeit the first under acting director Mick Mulvaney. The report covers supervisory and enforcement activities at the bureau between December 2017 and May 2018.
