JUDGE DENIES COMPETING SUMMARY JUDGMENT MOTIONS IN FDCPA CLASS ACTION
- A federal judge has denied motions for summary judgment from both the plaintiff and the defendant in a class-action lawsuit alleging violations of the Fair Debt Collection Practices Act when a collection agency accidentally aged accounts following an inputting error, even though the agency removed or subsequently updated all of the tradelines in the affected individuals’ credit reports.
APPEALS COURT UPHOLDS RULING COMPELLING SERVICER TO RESPOND TO CID FROM BCFP
- The Court of Appeals for the Third Circuit has affirmed a lower court’s ruling that compels a student loan servicing company to respond to a civil investigative demand letter from the Bureau of Consumer Financial Protection.

- So I sat through nearly three hours of the Senate Commerce Committee’s hearing yesterday on the Federal Communications Commission and I can safely report that it was a giant waste of time, at least as far as the hearing pertained to the Telephone Consumer Protection Act. I was expecting significantly more than what was said during the hearing. Sen. John Thune [R-S.D.], the chairman of the committee, mentioned robocalls during his opening remarks. And a couple of Senators made comments or asked basic questions about robocalls of the four FCC commissioners who were testifying, but there was nothing of value or substance that was really discussed.
SENATE DEMOCRATS INTRODUCE BILL TO AMEND FCRA, FDCPA FOR MEDICAL DEBTS
- A group of seven Senate Democrats have come together and introduced a bill that would amend the Fair Credit Reporting Act and Fair Debt Collection Practices Act to cover certain provisions related to the collection of medical-related debt.
