KRANINGER STANDS TALL DURING CONFIRMATION HEARING

  • Kathy Kraninger did her best impersonation of Patches O’Houlihan yesterday, effectively dodging questions about zero tolerance immigration policies and the federal government’s response to damage caused by Hurricane Maria in Puerto Rico last year, during her confirmation hearing before the Senate Banking Committee. To her credit, Kraninger never wavered, even during some blistering attacks from Senate Democrats. Even some who criticized her during the hearing admitted that Kraninger will likely be the next director of the Bureau of Consumer Financial Protection, where she is expected to continue leading in the manner set by her current boss, Mick Mulvaney.

 

APPEALS COURT UPHOLDS SUMMARY JUDGMENT AGAINST PLAINTIFF’S ATTORNEY IN FDCPA CASE

  • The Second Circuit Court of Appeals has upheld a lower court’s ruling against a plaintiff — himself a plaintiff’s lawyer — who had accused a defendant of violating the Fair Debt Collection Practices Act by inquiring about the nature of a disputed debt, as well as sanctions against the plaintiff and his attorney for misleading the court, disregarding a protective order, and for “needlessly multiplying” the proceedings.

 

PLAINTIFFS ALLEGE FDCPA CLASS ACTION OVER FAKE COURT DOCUMENTS

  • A plaintiff has filed a class-action lawsuit against a collection law firm, alleging the firm violated the Fair Debt Collection Practices Act when it sent the plaintiff a letter, which had the appearance of a court document and attempted to convince the plaintiff that her contesting of the debt should be terminated.
