FEDERAL JUDGE IN CALIFORNIA RULES COLLECTOR RETAINING PORTION OF TRANSACTION FEE IS VIOLATION OF STATE’S FDCPA
- A federal judge in California has ruled that individuals paying a voluntary transaction fee is sufficient to cover the “concrete” injury standing required to file a lawsuit in federal court. The plaintiffs have filed a class-action lawsuit against Santander Consumer USA regarding transaction fees that were paid when making payments via Western Union’s Speedpay service. The ruling was first reported by Blank Rome.
MULVANEY SHAKES UP CFPB’S ENFORCEMENT DEPARTMENTS
- Mick Mulvaney, the acting director of the Consumer Financial Protection Bureau, has stripped the agency’s Office of Fair Lending and Equal Opportunity of its enforcement power, according to a published report. The department was charged with policing discrimination in lending, but will now focus on consumer education and advocacy, according to an email circulated within got CFPB yesterday by Mulvaney.
NY AG FILES MOTION TO COMPEL IN SUIT AGAINST ALLEGED SCAMMERS
- The attorney general of New York has filed a motion seeking to compel a collection agency and its owner to turn over documents as part of a lawsuit filed against the pair alleging they were involved in illegal activities that scammed people out of millions of dollars. This is not the first time that the defendants have dragged their feet or been slow to respond to interrogatories from the plaintiffs. The motion was first reported by the law firm of Troutman Sanders.

- A news website in Washington, D.C., has published excerpts of emails between Richard Cordray, the former director of the Consumer Financial Protection Bureau, and members of his staff in the days leading up to his resignation last November. The emails appear to detail Cordray’s plans to have Leandra English be named the CFPB’s acting director upon Cordray’s resignation.
HOSPITAL TO HIRE WORKERS BEING LAID OFF BY CONIFER
- Frye Regional Medical Center in Hickory, N.C., will hire the 81 employees who are set to be laid off by Conifer Health Solutions, the hospital announced yesterday. Conifer had filed a notice with the North Carolina Department of Commerce announcing the layoffs. But instead of being out of work, those employees will work directly for the hospital instead.
