MASS. CONSENT ORDER SETS HIGHER STANDARD FOR LEGAL COLLECTIONS
- A recent consent order in Massachusetts is setting a higher standard for how legal collections must be conducted, according to a lawyer from the law firm of Ballard Spahr. The consent order, which was entered into with the law firm of Lustig, Glaser, & Wilson, established a number of requirements for how the firm can collect going forward. Those requirements are over and above what was previously law in the state of Massachusetts, and the “substantive provisions of the consent order will likely necessitate creation of new policies, procedures, and compliance monitoring law firms, creditors, debt collectors, and debt buyers engaged in legal collection in Massachusetts.”
