APPEALS COURT OVERTURNS TCPA CASE AGAINST COLLECTION AGENCY
- The U.S. Court of Appeals for the Ninth Circuit has reversed a lower court decision that alleged a collection agency, Adir International, used an automated telephone dialing system (ATDS), or autodialer, when sending text messages to a plaintiff. The ruling, however, was “Not for Publication,” which means it is not precedential and does not carry the same authority as a published opinion. Despite it being an unpublished opinion, the case can still be cited as an authority and the court can choose to give the ruling consideration in other cases.
COLLECTION AGENT CHARGED WITH STEALING $1.6 MILLION FROM CLIENT
- Norman Alpren, the president of MBI Associates, has been charged with stealing $1.6 million from a client, St. Barnabas Hospital. Alpren, who is facing up to 25 years in prison, failed to remit the money and allegedly used it to help run his agency. Alpren’s lawyer said the agency collected $13 million for the hospital during a four-year period.
GEORGIA PRISON HIRES COLLECTION AGENCY TO GO AFTER DEBTS FROM FORMER INMATES
- A Georgia prison system has hired LJ Ross to help collect $316,000 in unpaid debts from former inmates. If the amount collected is under $500, the collection agency will keep 35% as its fee. If the amount is over $500, the fee goes up to 40%. The cost of being incarcerated in the jail consists of a $12 booking fee, $26 a day for a person sentenced, $15 a day for work release, and a $5 charge if an inmate requests medical attention.
HOSPITALS HAVING PROBLEMS MANAGING MOUNTAINS OF UNPAID DEBTS
- An interesting look at the problems facing Chicago-area hospitals and healthcare organizations as they deal with an increase in the amount of unpaid debts from patients. One hospital has nearly $270 million in unpaid healthcare debts and two other hospitals each have more than $135 million. The 10 largest hospitals in Chicago have more than $700 million in uncompensated care debts.
