UTAH ATTORNEY BLASTS STATE FOR LACK OF CONSUMER PROTECTIONS

In response, the lawyer has begun filing class-action lawsuits against collection agencies — three in the last 45 days. There is no state entity responsible for investigating debt collection agencies, according to the lawyer and any complaints are instead referred to the Federal Trade Commission. The article recaps how a bill was passed during the 2013 legislative session that was recommended to be used in other states.

HOUSE SUBCOMMITTEE HEARS TESTIMONY ON MODERNIZING TCPA

  • A summary of the hearing on modernizing the Telephone Consumer Protection Act that was held by the House Energy & Commerce Subcommittee on Communications and Technology last week. What’s interesting is that for all the talk of modernizing the TCPA to reflect new technology like text messaging, email, and cell phones, a professor who testified said that he thinks consent from a consumer to be contacted on his or her cell phone should be made in writing, especially when it comes to third parties. Modernized, indeed.
