D.C. COURT OF APPEALS SCHEDULES ORAL ARGUMENTS IN ACA’S LAWSUIT AGAINST FCC
- The United States Court of Appeals for the District of Columbia has scheduled oral arguments in the case of ACA International v. Federal Communications Commission starting October 19, ACA International announced late last night. ACA International sued the FCC last July, after the regulatory agency issued a declaratory ruling that dramatically altered the context of the Telephone Consumer Protection Act. ACA’s lawsuit alleges that the FCC overstepped its authority in issuing the changes.
DITECH CLOSING COLLECTIONS OFFICE IN SAN ANTONIO
- Ditech Financial, a unit of Walter Investment Management Corp., has announced it will close a debt collection center in San Antonio, Texas, laying off nearly 80 employees. The company cited a more “normalized” housing market, with fewer foreclosures and delinquencies, as the reason why the office was no longer necessary.
CFPB ANNOUNCES SITE FOR DEBT COLLECTION FIELD HEARING
- The Consumer Financial Protection Bureau has announced the location for Thursday’s debt collection field hearing. It will take place at the McClellan Conference Center in McClellan, Calif.

- In advance of the CFPB’s field hearing later this week, the entire industry is speculating whether the agency is going to release the proposed rule for its regulation of debt collections or whether just the regulatory outline for the rule for the Small Business Regulatory Enforcement Fairness Act (SBREFA) hearing will be released. People are even going as far as to speculate the level of detail that will be included — such as will the CFPB place a limit on the number of times an individual can be contacted by a collector?
CFPB COMPLAINT DATABASE IN THE SPOTLIGHT
- Because we haven’t mentioned the CFPB enough already this morning … is the agency’s consumer complaint database an example of government overreach or a business opportunity for companies to connect with dis-satisfied customers and a chance to make things right? It might be both.
BANKS PREPARING FOR ADDITIONAL CONSUMER LOAN DEFAULTS
- Banks are stuffing hundreds of millions of dollars under their mattresses to prepare for additional loan losses, mainly in consumer loans. J.P. Morgan, for example, added $250 million to its loan-loss reserves for its credit card operation in the second quarter, the first time it has upped its provisions for losses in nearly six years.
