POLITICAL GROUPS SUE GOVERNMENT TO HAVE TCPA DECLARED UNCONSTITUTIONAL
- A bipartisan group of political organizations have filed suit against the federal government, aiming to have the Telephone Consumer Protection Act declared unconstitutional. The groups are arguing that the TCPA violates the First Amendment by restricting speech based on its content. The groups are using exemptions to the TCPA created by Congress and the Federal Communications Commission that have been created during the past 25 years as evidence that the TCPA favors commercial speech over “fully-protected political speech.”
HOUSE COMMITTEE SCHEDULES HEARING TO DISCUSS CFPB’S PROPOSED ARBITRATION RULE
- The House Financial Services Committee has scheduled a hearing for this coming Wednesday on the CFPB’s proposed rulemaking on arbitration. Given the title for the hearing, “Is it in the Public Interest and for the Protection of Consumers?” it should be clear that the Republican-controlled committee will have some harsh assessments of the proposal, which should make for interesting viewing. ACA International has come out strongly against the proposal.
