- The Bureau of Consumer Financial Protection will look at the scale of violations when considering enforcement actions, acting director Mick Mulvaney said during a speech in Washington, D.C., on Tuesday. A number of published reports have surfaced relating Mulvaney’s remarks, which indicate that the agency will look at how many violations, related to the total number of transactions in a given market.
NUMBER OF LAWSUITS FILED AGAINST COLLECTION AGENCIES FALLS IN APRIL
- In what might be a first, all of the data points tracked by WebRecon were lower in April than they were in March, including the number of complaints filed with the Bureau of Consumer Financial Protection, the number of complaints filed with the Better Business Bureau, and the number of lawsuits alleging violations of the Fair Debt Collection Practices Act, the Fair Credit Reporting Act, and the Telephone Consumer Protection Act, according to data released yesterday by the company.
CANCELED, BUT POSSIBLY STILL COLLECTIBLE
- A trio of lawyers from the law firm of Buckley Sandler have written a comprehensive overview of what to do when attempting to collect on charged-off debt, especially in cases where a 1099-C form has been issued to the individual in question. The lawyers lay out how a 1099-C form must be filed with the IRS when a debt in excess of $600 is canceled, but also discuss when and if a creditor can attempt to recover on a debt that has been charged off, including when a 1099-C form has been issued to the individual.

SMALL CLAIMS COURT IN INDIANA’S LARGEST COUNTY TO BECOME COURT OF RECORD
- The largest county in Indiana is finally catching up with the times and that could have some impact on debt collection activity in the Hoosier State. Starting July 1, small claims court in Marion County, the largest of the 92 counties in Indiana, will become a court of record, and any appeal will go to the Indiana Court of Appeals.
