EXPERTS SHARE INSIGHTS INTO HOW BEST TO MANAGE DISPUTED DEBT LETTERS
- A group of legal and compliance experts shared their insights and answered questions from industry executives about how best to manage dispute letters, especially those sent by credit repair organizations. Throwing them directly in the trash isn’t the best option, even though it’s the easiest one. Documenting the process is incredibly important, as is making sure that you’re not just implying with the Fair Credit Reporting Act, but also the Fair Debt Collection Practices Act as well.
JUDGE SMACKS DOWN PLAINTIFF WHO ACCUSED FIRM OF DECEPTION
- A federal judge in New Jersey may have found the bottom boundary for what constitutes a “least sophisticated consumer” under the Fair Debt Collection Practices Act. In this case, it is a plaintiff who claims not to have understood that the $82 in court costs added to the amount she owed on her unpaid credit card bill was misleading and deceptive, even though the agreement she signed with the creditor clearly stated that she would be on the hook for all “collection expenses, attorneys’ fees and court costs unless the law does not allow us to collect these amounts.”
HOW ROBOCALLERS WRECKED THE DO NOT CALL REGISTRY AND MADE LIFE MISERABLE FOR LEGITIMATE COMPANIES
- The Washington Post has published an interesting in-depth feature into the history and problems of the national Do Not Call registry and the “scourge” of robocalls. The article provides information about the apps being used by individuals and carriers, such as Nomorobo, which are cutting down on the number of robocalls making it through to consumers, but also keeping legitimate calls, like those from debt collectors, from being connected.
EDUCATION DEPT. AWARDS STUDENT LOAN CONTRACT TO COMPANY WITH TIES TO DEVOS
- Many thought that this would be the end, but the selection of Windham Professionals and Performant Corp. as the two companies selected by the Department of Education to collect on unpaid student loans may only be the beginning of the next chapter in this seemingly endless battle. The Department had selected seven companies nearly two years ago, but a series of lawsuits put the process on hold. Yesterday’s announcement will likely spark more protests and lawsuits, according to analysts. Especially when it was revealed that one of the companies has ties to Education Secretary Besty DeVos.
