WDNY JUDGE DISMISSES CLASS CLAIMS IN FDCPA SUIT OVER CHAIN OF TITLE ISSUES
- In a case that was defended by Jonathan Robbin of J. Robbin Law, a District Court judge in New York has dismissed class-action claims filed in a Fair Debt Collection Practices Act case and compelled arbitration on an individual basis after a plaintiff accused the defendant of filing a collection suit against him without having a proper chain of title.
BILL INTRODUCED IN SENATE TO CANCEL UTILITY DEBTS FOR LOW-INCOME HOUSEHOLDS
- A bill has been introduced in the Senate that would provide $30 billion to utility companies and broadband Internet providers across the country in order to prevent those companies from shutting off services to customers because of unpaid debts, especially those that have accumulated during the COVID-19 pandemic.
MORTGAGE SERVICERS ASK CFPB TO DELAY REG F EFFECTIVE DATE FOR 6 MONTHS
- Mortgage bankers don’t think a 60-day delay of the effective date of Regulation F is long enough for mortgage servicers to be ready to comply with the provisions of the Consumer Financial Protection Bureau’s debt collection rule, and are calling on the regulator to delay the rule’s implementation for six months. The request was made in the Mortgage Bankers Association’s comment on the proposal from the CFPB to delay the effective date of Regulation F to January 29, 2022, from November 30 of this year. Along with the comment from the MBA was a comment from more than two dozen consumer organizations, including the National Association of Consumer Advocates, calling on the CFPB to use the 60 days to rewrite the rule entirely.
CFPB COMPLAINTS KEEP ‘SOARING’ AS LAWSUIT TOTALS KEEP FALLING: WEBRECON
- Interestingly enough, the number of lawsuits filed in April claiming violations of the Fair Credit Reporting Act, the Fair Debt Collection Practices Act, and the Telephone Consumer Protection Act were all lower in April than the same month last year — which was the first full month that the COVID-19 pandemic had shut down most of the United States. The number of TCPA cases alone were down 79% in April compared with the same month a year ago, according to data published by WebRecon.
