JUDGE STRONGLY DENIES MOTION TO CERTIFY $4M TCPA SETTLEMENT CASE
- In a ruling that has been circulating quickly throughout the industry, a District Court judge in Pennsylvania has denied a motion to approve a class action settlement in a Telephone Consumer Protection Act case because of a “confluence of negative factors,” including that the judge did not believe that the defendant could only afford to settle the case for $4 million.
JUDGE GRANTS MTD IN FDCPA CASE OVER CREDITOR NAME IN LETTER, CLAIM OF OVERSHADOWING
- A District Court judge in New York has granted a defendant’s motion to dismiss after it was sued for allegedly violating the Fair Debt Collection Practices Act because it allegedly did not accurately convey the name of the current creditor to whom the debt was owed in a collection letter and because it allegedly overshadowed the validation notice by using boldface and a slightly larger font to direct the plaintiff to additional disclosures on the back page of the letter.

- In advance of his participation for the first time in a Democratic debate, former New York City mayor and presidential candidate Mike Bloomberg has released a “financial reform policy” that strengthens consumer protections and details specific steps he would take to regulate the collections industry if he were to be elected president this November.
