CALIFORNIA APPEALS COURT OVERTURNS RULING IN FAVOR OF COLLECTOR THAT STAPLED NOTE TO SUMMONS

  • A least sophisticated consumer would have thought that the note, which provided instructions to call the agency if the individual had any questions, was coming from the court, the Appeals Court ruled
  • The defendant argued that the note was not a communication because it doesn’t mention anything about the debt, but because it was stapled to a summons, the Appeals Court rejected that argument.

  • The scheme led to the Department of Education discharging $48 million of student loans.

BILL INTRODUCED TO PREVENT MASS STUDENT LOAN CANCELLATIONS AS WHITE HOUSE PREPS ANNOUNCEMENT

  • Another bill, this time in the House of Representatives, seeks to handcuff the administration from cancelling student loan debt, which it is expected to announce today.
  • If it tries to cancel more than $100,000 in student loans, the Education Department would need obtain funding from Congress, if the bill is enacted.
