JUDGE DENIES MTD IN FDCPA CASE
- A District Court judge in Texas has denied motions to dismiss filed by three defendants in a Fair Debt Collection Practices Act case, ruling that the one defendant who claimed not to have been properly served with the summons and complaint was, that all of the defendants can be sued in Texas because that is where the plaintiff lived, and that the plaintiff adequately stated a claim.
CONSUMERS PAYING MORE FOR HEALTHCARE LEADS TO LOWER COLLECTION RATES
- The amount of bad debt at healthcare providers that is attributable to self-pay after insurance accounts grew sixfold between 2018 and 2021, and represented nearly 60% of all bad debt, according to a report released this month by Crowe Revenue Cycle Analytics. Once out-of-pocket expenses reached $7,500, the report labeled that the “vanishing point” because collection rates dropped off “starkly” at that point.
WISC. LEGAL SERVICES GROUP TO USE GRANT FUNDS TO HELP PEOPLE SUED BY COLLECTORS, DEBT BUYERS
- Legal Action of Wisconsin, the largest non-profit free civil legal services law firm in the state, has received a grant of nearly $400,000 that it plans to use help low-income individuals who are being sued by debt collectors and debt buyers in small claims court, according to a published report.
