- A class-action lawsuit has been filed in federal court in New York accusing a collector of violating Regulation F and the Fair Debt Collection Practices Act because the itemization of the debt in the Model Validation Notice did not match an itemization of the debt on the reverse side of the notice.
JUDGE PARTIALLY GRANTS MSJ FOR PLAINTIFF IN FDCPA CASE OVER COLLECTING INCORRECT AMOUNT
- A District Court judge in Washington has partially granted a plaintiff’s motion for summary judgment, ruling that the defendant’s attempts to collect an unpaid apartment debt that was inflated because the creditor determined that the plaintiff had forfeited her security deposit violated certain provisions of the Fair Debt Collection Practices Act.
AGENCY FINED $20K FOR VIOLATING EARLIER CONSENT ORDER
- The Minnesota Department of Commerce has assessed $20,000 in fines to a collection agency that was accused of continuing to violate an earlier consent order in which the agency allegedly violated the Fair Debt Collection Practices Act and state law in Minnesota.
