JUDGE PARTIALLY GRANTS DEFENDANT’S MSJ IN FDCPA CASE OVER LOCATION INFORMATION CALLS
- A District Court judge in New York has partially granted a defendant’s motion for summary judgment, denied the plaintiff’s motion for summary judgment in a Fair Debt Collection Practices Act case involving a pair of location information calls that were placed to the plaintiff’s mother. The ruling overturns a recommendation from a Magistrate Court judge that said the second location information call and a request from the defendant’s representative asking the mother to have the daughter call the defendant back were in violation of the FDCPA.
LENDER TO PAY $19M FOR ‘WIDESPREAD’ CREDIT REPORTING ‘FAILURES’
- The Consumer Financial Protection Bureau yesterday announced a consent order with Hyundai Capital America, the financing arm of Hyundai Motors, in which the company will pay $19 million in restitution and fines after being accused of reporting inaccurate information to the credit reporting agencies on more than 2 million of its customers.
CALIF. APPEALS COURT UPHOLDS RULING FOR BANK IN CALL CENTER COMPENSATION CASE
- A California Appeals Court has upheld a lower court’s summary judgment ruling in favor of a financial institution that was sued for not separately itemizing a bonus paid to its call center workers for fluently speaking languages other than English, ruling that the bank did not violate state law in how it compensated employees with this particular skillset.
