- When a consumer tells a collector that he or she is not responsible for a debt, the collector usually has a process that seeks to get to the bottom of whether the consumer is telling the truth. But how far is too far? A complaint has been filed against a collector, accusing it of violating the Fair Debt Collection Practices Act and Regulation F because the emails it sent did not contain an opt-out notice and because the documentation it asked for was too “onerous” and an attempt to “dissuade” the consumer from defending herself. JUDGE GRANTS MSJ FOR DEFENDANT IN FDCPA CASE OVER DISPUTED DEBT
- A District Court judge in Georgia has granted a defendant’s motion for summary judgment, ruling that it was entitled to the Fair Debt Collection Practices Act’s bona fide error defense after a plaintiff disputed a debt that was not marked as disputed on the plaintiff’s credit report.
CONN. REGULATOR FINES COMPANY $10K FOR OPERATING WITHOUT LICENSE
- The Connecticut Department of Banking has levied a $10,000 fine against a company for operating as a consumer collection agency in the state without obtaining the proper license.
