JUDGE PARTIALLY GRANTS DEFENSE’S MOTION IN FDCPA CASE OVER UNDISPUTED DEBT
- A Magistrate judge in California has partially granted a defendant’s motion for judgment on the pleadings in a Fair Debt Collection Practices Act case in which the plaintiff claimed the defendant failed to report to the credit reporting agencies that the debt in question was no longer being disputed, ruling that the communications made to the CRAs were not “in connection with the collection of any debt.”
CFPB REPORT ANALYZES CONSUMER COMPLAINTS ON MEDICAL DEBTS, SOME ‘FEEL FORCED‘ TO PAY DEBTS NOT OWED
- The Consumer Financial Protection Bureau yesterday released a report using the complaints submitted by consumers related to issues with medical debts to conclude that a lot of people “feel forced” to pay debts that have already been paid or were never owed to begin with, and that credit reporting healthcare debts can be “coercive” and “used as a weapon” to get people to pay debts they do not owe, according to the Director of the CFPB.
UTAH MAKING CHANGES TO COLLECTION LITIGATION PROCESS
- The legal system is an “ineffective vehicle” for collecting unpaid debts for both plaintiffs and defendants, according to research conducted by the Utah Bar Foundation, in conjunction with Pew Charitable Trusts, showing that showing up to defend against a collection lawsuit often leads to more debt while judgments obtained by plaintiffs rarely allow creditors to recover the full balance that is owed.
