BEDARD BREAKS DOWN HOW REG F ADDRESSES UNFAIR AND UNCONSCIONABLE COLLECTIONS

  • Section 1006.22 of Regulation F — the Consumer Financial Protection Bureau’s debt collection rule — is the section that suffers from a bit of a technology identity crisis, but still includes some new wrinkles in laying out the kinds of behavior that are prohibited when attempting to collect on unpaid debts. In the newest episode of “You Wanted a Rule, You Got a Rule” John Bedard of Bedard Law Group walks through the technology timeline and identifies the potential problem areas that could get collection agencies in some hot water.

APPEALS COURT AFFIRMS DISMISSAL OF FDCPA SUITS OVER ISSUE WITH COLLECTION LAWSUIT, LACK OF TITLE CHAIN

  • The Eighth Circuit Court of Appeals has upheld the dismissal of a pair of lawsuits filed against a collection law firm that accused it of violating the Fair Debt Collection Practices Act because it included “disbursements” in a statement of claim document when collection lawsuits were filed against the plaintiffs, and because the debt buyer that purchased the accounts did not have a full and complete chain of title when it placed the accounts for collection.

SENATE BANKING COMMITTEE TO VOTE ON CHOPRA NOMINATION TOMORROW

  • The Senate Banking Committee has announced that it will vote tomorrow on the nomination of Rohit Chopra to be the next director of the Consumer Financial Protection Bureau. Should he be approved by the Senate Banking Committee, Chopra’s nomination would go to the entire Senate for approval in the final step before Chopra can take over leadership of the agency.
