BEDARD BREAKS DOWN RULE’S PROVISIONS RELATED TO LOCATION INFORMATION
- In issuing its debt collection rule, the Consumer Financial Protection Bureau had the opportunity to update a rule that had been left largely untouched since it went into effect more than 40 years ago. And, as has been discussed in previous videos, the CFPB did opt to modernize how debts are collected. But, as John Bedard details in the latest episode of “You Wanted a Rule, You Got a Rule,” there are components of the Fair Debt Collection Practices Act that the CFPB opted to leave largely in tact. And one of those sections was how collectors can speak with third parties to acquire location information of individuals with unpaid debts.
PROPOSED COLO. STUDENT LOAN COLLECTION OVERHAUL BEING CONSIDERED
- A bill is circulating around the Colorado legislature that would dramatically overhaul how student loans are collected in the state, removing an exemption for licensed collection agencies while also imposing new disclosure requirements and imposing extensive civil liability exposure for those found to violate the provisions of the bill, should it become law.
OHIO BILL WOULD PLACE MORATORIUM ON SOME STUDENT LOAN, HEALTHCARE DEBT COLLECTION
- A bill is moving through the legislature in Ohio that would halt the collection of all debts owed to any state college or university and any hospital operated by a college or university while also pausing the accrual of interest and collection fees on those debts.
