JUDGE DEFINES ‘DEFAULT’ WHEN GRANTING DEFENSE’S MSJ IN FDCPA CASE OVER MEDICAL DEBT
- A District Court judge in Indiana has granted a defendant’s motion for summary judgment after it was sued for violating the Fair Debt Collection Practices Act and, at the same time, grappled with a provision of the statute that probably should not be so ambiguous — when does a debt go into default?
DELINQUENCY RATES HOLDING STEADY, BUT SIGNS POINTING TO DEBT PROBLEMS DOWN THE LINE FOR CONSUMERS
- Consistent with anecdotal reports from collection agencies across the country that individuals are interested in making payments and arrangements to pay off their debts, a report from TransUnion reveals that delinquency rates in April were in line with the rates from April 2019. More surprisingly is that delinquency rates dropped from March 2020 to April, as the COVID-19 pandemic shut down more of the country. But trouble may be on the horizon.
CONNECTICUT EXTENDS WORK-FROM-HOME ALLOWANCE
- The Connecticut Department of Banking has extended its no-action position regarding licensed entities, including collection agencies, that are allowing employees to work from home during the coronavirus pandemic. The position will now remain in effect until June 30.
