LOS ANGELES COUNCIL APPROVES PROPOSAL CALLING FOR HALT TO COLLECTIONS, LABELING AGENCIES AS NON-ESSENTIAL
- Not to be outdone by the metropolis on the other side of the country, the city council of Los Angeles has unanimously passed a proposal that calls for collection agencies to be labeled as non-essential businesses and for a moratorium on all collection activities within the city for the duration of the coronavirus pandemic.
APPEALS COURT UPHOLDS MSJ FOR PLAINTIFF IN FDCPA TIME-BARRED DEBT CASE
- The Court of Appeals for the Fifth Circuit has upheld a lower court’s summary judgment ruling in favor of a plaintiff who received collection letters attempting to collect on debt for which the statute of limitations had expired, a fact that was not mentioned in those letters.
REPORT ACCUSES CFPB OF MANIPULATING RESEARCH WHEN REVISING PAYDAY LENDING RULE
- A report from The New York Times is accusing individuals at the Consumer Financial Protection Bureau of manipulating “the research process to justify altering” its payday lending rule, based on a 14-page memo that was written by an economist at the agency on his last day on the job last year. The report also revealed that the CFPB is expected to release the updated payday lending rule this week.
