JUDGE CALLS OUT PLAINTIFF FOR ‘FRAUDULENT CONDUCT’ IN GRANTING DEFENDANT’S MSJ
- A District Court judge in Maryland has smacked down a plaintiff, falling short of accusing her of perjury, but questioning her attempts at “justify[ing] her fraudulent conduct,” in granting a defendant’s motion for summary judgment after it was sued for violating the Fair Debt Collection Practices Act and the Fair Credit Reporting Act in attempting to collect on a debt the plaintiff said was not hers, despite evidence to the contrary.
DIFFERING AMOUNTS IN DOCUMENTS LEADS JUDGE TO DENY MTD IN FDCPA CASE
- A District Court judge in Kentucky has dismissed claims that a collection law firm violated the Fair Debt Collection Practices Act when it sued to collect on an unpaid debt, but denied a motion to dismiss over claims that the defendant violated the FDCPA over discrepancies in the amount owed that were communicated to the plaintiff in the collection complaint, a verification letter, and in account statements from the original creditor.

- A surgeon and professor who has turned his focus to the issues of medical debt has recently released a new book that looks at the lengths hospitals have to go to in collecting unpaid bills while also profiling individuals and companies that are being innovating and “disrupting medical care to help solve root problems the industry faces,” according to a published report.
REPORT WARNS PUBLIC ABOUT COLLECTORS USING SOCIAL MEDIA
- Tying together the Consumer Financial Protection Bureau’s proposed debt collection rule and a comment from New York Attorney General Letitia James, a local news outlet in Rochester, N.Y., is warning individuals about how collectors are turning to “social media to collect money owed.”
