JUDGE GRANTS MSJ FOR DEFENSE IN FDCPA CASE BECAUSE PLAINTIFF DID NOT PROVIDE ENOUGH EVIDENCE
- A District Court judge in Illinois has granted a defendant’s motion for summary judgment after it was accused of violating the Fair Debt Collection Practices Act by sending a collection letter that, along with the amount of the debt, included “Accrued Interest: $0.00” and warned of an additional fee should a check be returned because of insufficient funds.
LOAN SERVICER LAUNCHES THIRD-PARTY COLLECTION AGENCY
- First Associates, a loan servicer, has announced the launch of its own third-party collection agency, Activate Financial. The company will specialize in collecting automotive, credit card, installment and personal loan, student loan and healthcare debt, but “is standing by to offer support across all asset classes,” according to a press release announcing the company’s launch.

- We haven’t seen one of these in a while, but a District Court judge in New Jersey has denied a plaintiff’s motion for summary judgment and given the plaintiff until next week to show cause why summary judgment should not be granted for the defendant after it was accused of violating the Fair Debt Collection Practices Act by allowing the plaintiff’s account number to show through the glassine window of an envelope containing a collection letter.
