JUDGE DENIES MOTION TO DISMISS FDCPA CASE OVER COLLECTOR NOT HAVING PROPER LICENSE

  • A District Court judge in New Jersey has denied a motion to dismiss and a motion for summary judgment filed by a collection agency after it was accused in a class action lawsuit of violating the Fair Debt Collection Practices Act by not having the proper license to purchase the plaintiff’s debt, which did not give the defendant the legal ability to collect on the debt.

  • Private debt collection is one of five “serious” problems at the Internal Revenue Service, according to the National Taxpayer Advocate in her annual report to Congress, arguing that the program of outsourcing unpaid debts to one of four collection agencies “continued to burden taxpayers who are likely experiencing economic hardship while inactive private collection agency inventory accumulates.”
