JUDGE DENIES CERTIFICATON IN TCPA SUIT BECAUSE PLAINTIFF COULD NOT BE IDENTIFIED AS POTENTIAL CLASS MEMBER
- A federal judge in Florida has denied certification of a potential class-action lawsuit after a furniture store was accused of violating the Telephone Consumer Protection Act by making calls to an individual’s cell phone without consent because the process used by the plaintiff’s expert to determine the size of the class would not have discovered the plaintiff as a potential class member.
NEW NOTIFICATION LAW IN CALIFORNIA GOES INTO EFFECT ON TUESDAY
- Nothing necessarily new here, except to remind everyone that a new law is going into effect in California on Tuesday that will require debt collectors to provide notification to individuals when attempting to collect a debt where the statute of limitations has expired. The law, AB 1526, is one of the biggest compliance changes for the ARM industry that will go into effect when the calendar turns to 2019 next week.
