COLLECTION AGENCY AGREES TO $9 MILLION SETTLEMENT WITH CALIFORNIA COUNTY DAs

  • Allied Interstate, and its parent company, iQor Holdings, have agreed to pay $9 million to settle a lawsuit filed by 18 California county prosecutors that alleged the collection agency violated the state’s Rosenthal Fair Debt Collection Practices Act and the federal Fair Debt Collection Practices Act and Telephone Consumer Protection Act by contacting individuals on their cell phones using an automatic telephone dialing system without obtaining the proper consent.

 

SECOND CIRCUIT UPHOLDS SUMMARY JUDGMENT IN FAVOR OF DEFENSE IN AVILA-RELATED LAWSUIT

  • The Second Circuit Court of Appeals has upheld a lower court’s summary judgment in favor of a defendant who was sued for allegedly violating the Fair Debt Collection Practices Act by not mentioning in a collection letter that interest and fees may be accruing on an account, even though fees and interest were not accruing.

 

WOMAN WHO SET UP COLLECTION AGENCY TO STEAL FROM JOB SENTENCED TO 26 MONTHS IN PRISON 

  • A Virginia woman has been sentenced to 26 months in prison for stealing $300,000 from the woman’s clinic she worked at, going as far as to create her own collection agency, but not remit any of the funds collected back to her workplace.
